Subject to Articles 2 to 4 and 7 , no officer , soldier , or other person , shall be entitled to claim hereafter any promotion , retired pay , pension , or other advantage conferred by any provision of this Our Warrant , in the event of such provision being at any time added to , varied or cancelled .sx The rates of pay , half-pay , retired pay , gratuities and pensions , in this Our Warrant , shall be subject to revision as follows .sx The revision shall apply to the rates in payment at the time of the revision as well as to new grants .sx ( a ) The rates of officers' pay , half-pay , service retired pay and gratuities , whether introduced from 1st July , 1919 , or from a subsequent date , and including those introduced as from 26th October , 1925 , shall be subject to revision , either upwards or downwards to an extent not exceeding 20 per cent .sx , in relation to the variation in the cost of living since 1st July , 1919 .sx The reduction of 7 per cent .sx which was ordered by Our Warrant dated 20th December , 1929 , and of 8 per cent , which was ordered by Our Warrant dated 27th January , 1931 , shall be applied to the rates in the same manner and to the extent specified in Our Warrants dated 27th June , 1924 , 28th February , 1925 , and 16th October , 1925 .sx A further revision of the rates may take place with effect from 1st July , 1933 , and thereafter every three years .sx New rates , introduced after the date of this Our Warrant , shall , unless otherwise provided , be subject from the date of introduction to revisions already applying to rates included in this Our Warrant and also to future revisions .sx ( b ) The rates of officers' disability retired pay and gratuities , and pensions and gratuities of their widows and dependants , as well as the disability pensions and gratuities of soldiers and pensions and gratuities of their widows and dependants , may be revised as and when Our Further Will and Pleasure may determine .sx ( c ) The rates of pay and retired pay of members of Our Queen Alexandra's Imperial Military Nursing Service and Our late Queen Alexandra's Military Families Nursing Service may be revised as and when Our Further Will and Pleasure may determine .sx Save that an officer who was serving under a permanent regular commission on 12th September , 1919 , and would receive on or after retirement , for the rank he then held , higher retired pay under Our Warrant of 1st December , 1914 , may elect to draw such retired pay in lieu of the rates in this Our Warrant , so that no revision of the scale of retired pay in this Our Warrant shall reduce such an officer's retired pay below the rate reserved by this Article .sx Nor shall an officer who was in receipt of retired pay before 13th September , 1919 , whose retired pay has been re-assessed under the provisions of our Warrant of that date , have his retired pay reduced , by revision under this Article , below the original rate .sx Except where otherwise provided , nothing contained in this Our Warrant shall be held to deprive any officer , soldier , or other person who retired from Our Service before the date of this Our Warrant of any pecuniary advantage of which he is already in enjoyment in virtue of such retirement .sx Any officer ( other than a retired officer re-employed in connection with a national emergency ) serving on the active list under a permanent regular commission at the date of this Our Warrant shall , on being placed on the half-pay list or on retirement , and his family shall , on his death , be eligible to accept in lieu of the rates granted by this Our Warrant such half-pay , gratuity on retirement , retired pay , widow's ordinary pension or compassionate allowance ( as the case may be ) as might have been awarded to him or his family , under regulations in force on the day before the date of this Our Warrant in accordance with the substantive or honorary rank he held on that day .sx Service for the purpose of this Article shall be counted according to the regulations in force on the day before the date of this Our Warrant for the counting of service .sx A soldier entitled to pension , for the payment of which money may be voted by Parliament , may have the benefit of any Warrant or regulation in force at the date of his enlistment .sx A soldier who was serving on 12th September , 1919 , may be pensioned on discharge , under the Warrants in force on that date , if more favourable to him than the benefits of later Warrants , as provided in Our Warrant of 13th September , 1919 .sx Subject to Articles 6 and 7 , no officer , soldier or other person whose pay is herein laid down shall be held entitled to pay at other rates than those herein prescribed .sx An officer , soldier , or other person , whose rate of pay for the rank or appointment which he held on the day before the date of this Our Warrant was provided for in Our Warrant of 12th March , 1926 , and is omitted from this Our Warrant , shall continue to be entitled , subject to the conditions on which such rate was issuable , to the rate of pay so provided for him for the rank or appointment so held , so long as he shall continue to hold it , unless any deficiency between such rate of pay and that laid down for his rank or appointment by this Our Warrant shall have been made good by some other provision in this Our Warrant .sx An officer , soldier , or other person who , when given the option , elected to retain the rates and conditions regarding pay , appointment , promotion , and non-effective pay provided in previous Warrants , instead of accepting the terms embodied in this Our Warrant , may continue to serve under the Warrant governing the rates and conditions in lieu of those now provided .sx Except under such exceptional circumstances as may be approved by Our Army Council or by an officer duly authorized by them , no claim shall be admitted for pay or other pecuniary advantage granted by this Our Warrant relating to any period more than 12 months antecedent to the date of claim .sx The pay , non-effective pay , and all other emoluments granted by this Our Warrant to an officer , soldier , or other person , shall be held liable-to be stopped , on the order of Our Army Council , to meet any public claim there may be against him , any regimental debt or any debt to the Navy , Army and Air Force Institutes that may be due from him , or any regimental claim or any claim by the Navy , Army and Air Force Institutes which Our Army Council may direct him to pay .sx Where an officer , soldier , or other person for whose emoluments provision is made in this Our Warrant is injured or killed in such circumstances that a pension , allowance or grant is payable under this Our Warrant to or in respect of him , and where he or his widow , child or dependant receives compensation from or on behalf of the person alleged to be responsible for the act , omission , or circumstances which caused the injury or death , any such compensation may be taken into consideration in assessing any pension , allowance , or grant which might be awarded to or in respect of the officer , soldier or other person , and where the compensation is received after assessment it may be taken into consideration and the assessment may be amended or cancelled accordingly .sx If no such compensation has been received and the person to whom the pension , allowance or grant is payable under this Our Warrant refuses unreasonably , in the opinion of Our Army Council , to prefer a claim for such compensation , the pension , allowance or grant under this Our Warrant may be withheld or reduced on the order of Our Army Council .sx PART 3 .sx OFFICERS .sx SECTION I. APPOINTMENT , PROMOTION , EXCHANGES , &c .sx I. FIRST APPOINTMENTS COMMISSIONS .sx General Rule .sx Commissions in Our Regular Army shall be given to persons duly qualified under regulations approved by Our Army Council .sx Second-Lieutenant .sx A commission as second-lieutenant in Our Cavalry , Infantry , or Royal Tank Corps may be given To a cadet who has passed through a course of instruction at Our Royal Military College , Sandhurst , or to a cadet of Our Royal Military College , Kingston , Canada .sx To an officer of the supplementary list of Our Regular Army Reserve of Officers , Our Supplementary Reserve , Our Bermuda Militia Artillery , Our King's Own Malta Regiment , or Our Territorial Army .sx To a candidate from a university .sx To a warrant officer or non-commissioned officer .sx In the case of an appointment as second-lieutenant of a regiment of Our Household Cavalry , the nomination for Our approval of a qualified candidate shall be vested in the colonel-in-chief of the brigade .sx In the case of an appointment as second-lieutenant in Our Foot Guards , the colonel of the regiment concerned shall nominate for Our approval a candidate qualified under this Article .sx A commission as second-lieutenant in Our Royal Artillery may be given To a cadet who has passed through a course of instruction at Our Royal Military Academy , Woolwich , or to a cadet of Our Royal Military College , Kingston , Canada .sx To a candidate from a university .sx To a warrant officer or non-commissioned officer .sx 30 .sx A commission as second-lieutenant in Our Royal Engineers may be given To a cadet who has passed through a course of instruction at Our Royal Military Academy , Woolwich , or to a cadet of Our Royal Military College , Kingston , Canada .sx To a candidate from a university .sx To a warrant officer or non-commissioned officer .sx 31 .sx A commission as second-lieutenant in Our Royal Corps of Signals may be given .sx To a cadet who has passed through a course of instruction at Our Royal Military Academy , Woolwich .sx To a cadet of Our Royal Military College , Kingston , Canada .sx To a candidate from a university .sx 32 .sx A commission as second-lieutenant on the unattached list of candidates for appointment to Our Indian Army may be given To a cadet who has passed through a course of instruction .sx at Our Royal Military College , Sandhurst , or to a .sx cadet of Our Royal Military College , Kingston , .sx Canada .sx To an officer of Our Supplementary Reserve or Our Territorial Army .sx To a candidate from a university .sx To a candidate approved by Our Army Council on the recommendation of Our Secretary of State for India .sx 33 .sx An officer given a commission from Our Royal Military College , Kingston , Canada , may be granted an antedate not exceeding 12 months , provided that he shall not be granted an antedate to a date prior to his 20th birthday .sx 34 .sx An officer granted a commission as a candidate from .sx a recognized university may be granted an antedate under such regulations as may be laid down from time to time by Our Army Council with the approval of the Lords Commissioners of Our Treasury .sx Lieutenant .sx A commission as lieutenant on the list of district officers of Our Royal Artillery may be given to a warrant officer , Class I , of Our Royal Artillery not over 45 years of age , provided that he attained the rank of warrant officer , Class I , before attaining the age of 40 years .sx A commission as lieutenant may be given in Our Royal Army Medical Corps or Our Royal Army Veterinary Corps .sx The commission shall bear the date of the officer's appointment as lieutenant on probation .sx An officer of Our Royal Army Medical Corps who is commissioned after holding an approved whole-time appointment in a recognized civil hospital may be granted an antedate covering the period of his appointment but not exceeding 12 months , provided that the interval between the termination of the hospital appointment and the date of entry into the service shall not ordinarily exceed 6 months .sx A commission as lieutenant may be given in Our Army Dental Corps to a person approved by Our Army Council .sx An officer of Our Army Dental Corps , who is commissioned after holding an approved whole-time appointment in a recognized civil dental hospital or in the dental department of a recognized civil general hospital may be granted an antedate covering the period of his appointment but not exceeding 6 months , provided that the interval between the termination of the hospital appointment and the date of entry into the service shall not ordinarily exceed 6 months .sx
